Court to Reconsider Decision That Allowed Trump to Deploy Military Forces to Oregon City

The ninth circuit court has maintained a ban on deploying national guard in Portland, Oregon, after a latest legal decision.

Judicial Panel Agrees to Rehear Case

The ninth circuit court of appeals decided on Tuesday that it would rehear the legal dispute concerning the president’s authority with an larger group of eleven justices. The court also overturned a previous decision from a smaller judicial group that had sided with the administration.

Legal Saga Over Troop Deployment

This order represents the latest turn in a protracted legal battle over whether the administration has the authority and justification to send national guard forces in Portland. Approximately 200 federalized guard members have been in limbo since the end of September when the mobilization attempt was initiated in due to ongoing demonstrations.

Differing Viewpoints

The administration has claimed that federal officials at the immigration center in south Portland were under attack, while local authorities maintain that local officers have control of the circumstances.

In defiance of descriptions of the city as “war ravaged”, residents have been sharing videos of lush hiking trails and a vibrant culinary culture, and organizing events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Court Proceedings

The appeals court decision came after a US district judge in Portland enacted two temporary restraining orders this period – one blocking the federal control of the state troops, and another prohibiting the deployment of any military personnel in Oregon, after attempts to evade the initial injunction by mobilizing out-of-state forces.

On the previous day, the appeals court had put the first ruling on hold – permitting command of state troops – but the subsequent injunction remained in place, blocking the actual deployment of the troops.

En Banc Review

The Tuesday decision means the matter will be heard “en banc” – with both rulings under consideration together – by a group of eleven justices.

“This ruling shows that facts are important and that the courts are striving to hold this administration accountable. The founding document restricts the executive authority, and local populations cannot be treated as a testing site for unchecked federal authority,” stated the legal representative in a statement.

“The judicial body is sending a definite signal: the executive leader cannot dispatch the armed forces into US cities without cause. We will continue protecting Oregon’s laws, values, and autonomy as this case moves forward and our legal battle continues in the judicial system.”
